Canada's immigration framework has taken another significant step forward with a new policy introduced by Immigration, Refugees, and Citizenship Canada (IRCC). This policy, effective until December 31, 2024, offers foreign workers who have submitted an Expression of Interest (EOI) to specific Provincial Nominee Programs (PNPs) a streamlined path to obtain an open work permit (OWP). This development primarily benefits workers in Alberta, Manitoba, and Yukon, enhancing their ability to remain employed in Canada while navigating the permanent residency process.
The OWP policy allows eligible foreign nationals to work for any employer in Canada without being tied to a specific job or employer. This policy is particularly relevant for workers who are already contributing to the labor market in Alberta, Manitoba, or Yukon under a PNP. By facilitating continued employment and stability, the policy aims to support both foreign workers and the local economies of participating provinces.
The open work permit under this policy is valid for up to two years, offering applicants significant flexibility. However, it cannot be extended beyond this period. If an applicant's passport expires before the two-year timeframe, the work permit will expire on the passport's expiry date.
An added benefit of this policy is the inclusion of family members. If an applicant's OWP application is approved, their spouse or common-law partner can apply for an open work permit as well. Dependent children in kindergarten through grade 12 can either attend school without a study permit (if already in Canada) or apply for a study permit to join the applicant.
To qualify for this open work permit, applicants must meet several specific requirements:
● Applicants must hold a valid work permit, or have had one that expired after May 7, 2024, with a restoration application in progress. (workers awaiting a decision on a work permit extension application are also eligible)
● Applicants must possess a support letter from the provincial or territorial government, confirming their inclusion in the Expression of Interest pool or another Provincial Nominee Program.
● A signed letter of employment from the current employer in one of the participating provinces is mandatory.
● Leaving Canada during this time could result in the loss of temporary resident status, requiring the process to be restarted.
The new OWP policy requires applications to be submitted online. Border applications or in-person submissions are not accepted. Applicants should ensure they gather all necessary documentation and follow the outlined procedures to avoid delays.
● A copy of the candidate's current or recently expired work permit.
● A signed letter of employment from their employer.
● A copy of the passport ID page.
● A digital photo taken within the last six months.
● A support letter from a provincial or territorial government.
Additional documentation may be requested based on individual circumstances.
Alberta, Manitoba, and Yukon have been grappling with labor market challenges, particularly in industries such as healthcare, construction, and technology. This policy helps address these issues by ensuring that skilled workers can remain employed while awaiting permanent residency. Moreover, it encourages long-term settlement and community integration, as workers gain the opportunity to explore various employment options.
The new OWP policy complements the overall immigration strategy by easing the transition from temporary work to permanent residency.
