Eligibility Criteria

Intra-company transferees may apply for work permits under the general provision if they are:

  • Employment Relationship: They must be employed by a national company and seek to work in a parent, subsidiary, branch, or affiliate of that company.
  • Qualifying Transfer: The transfer must be to an entity with a qualifying relationship and the employee must be assigned to a legitimate, ongoing establishment of that company, typically having been with the company for at least 18–24 months.
  • Position: The role must be in an executive, senior managerial, or specialized knowledge capacity.
  • Employment History: They must have worked continuously (full-time, not part-time) with the company for at least one year within the last three years.
  • Temporary Stay: Coming to Canada for a temporary period.
  • Immigration Compliance: They must meet all immigration requirements for temporary entry into Canada.

Requirements for Intra-Company Transferees to Canada

  1. Location Requirement: Intra-company transferees to Canada are not necessarily required to relocate to Canada permanently. However, they must physically occupy a position within the Canadian branch of the company.
  2. Employer-Employee Relationship: There should be a clear employer-employee relationship between the foreign worker and the Canadian company.

Documentation requirements

  1. Employment Confirmation: Confirmation that the foreign national is currently employed by a national enterprise outside Canada and intends to work in Canada at a parent, subsidiary, branch, or affiliate of that enterprise.
  2. Employment History: Evidence that the foreign national has been employed continuously (full-time) by the enterprise outside Canada for at least one year within the three-year period preceding the application date. This should be verified through payroll records or contracts.

Position Details Outside Canada:

  1. Nature of Position in Canada: Detailed outline of the position the applicant will occupy in Canada, including: Managerial, Executive, or Specialized Knowledge: Clarification of whether the applicant's position qualifies as:
    • Evidence of Specialized Knowledge: Documentation demonstrating that the applicant possesses the specialized knowledge required for the position in Canada, and that the position itself necessitates such specialized knowledge.
  1. Intended Duration of Stay: Indication of how long the applicant intends to stay in Canada under the intra-company transferee arrangement.
  2. Relationship between Enterprises: Description of the relationship between the national enterprise in Canada and its counterpart in the foreign country.
